Jersey no longer covered by EUTMs

In March 2024, the Government of Jersey made a significant announcement regarding the status of European Union Trade Marks (EUTMs).

Changes

It has been declared that EUTMs will no longer provide registered trade mark protection in Jersey.

This is a change from the previous arrangement where, between October 2000 and April 2009, EUTMs automatically protected Jersey. The Government of Jersey has clarified that this protection ceased as of 12 April 2009.

Need to know

If you or your clients have been relying on EUTMs to provide registered trade mark protection in Jersey, you must consider:

  1. Re-registration of UK Trade Marks: re-registering UK trade marks, including comparable UK trade mark registrations created following the UK’s exit from the European Union.
  2. International Trade Marks Designating the UK: international trade mark registrations designating the UK automatically provide protection in Jersey.
