The Intellectual Property Act 2014 (the 2014 Act) received Royal Assent on 14 May 2014 and will be implemented via a series of commencement orders over the coming months. In this article, originally published in the CIPA Journal in September 2014, Withers & Rogers Patent Attorneys Michael Jaeger and Nick Wallin discuss how one order aims to simplify the rules on first ownership of UK unregistered design right. The results may however shock product designers and lead to some unexpected owners of design right.
